Filing Bankruptcy STOPS creditor harassment

The minute we file for bankruptcy on your behalf, all creditor harassment stops immediately. This includes stopping: foreclosures, repossessions, lawsuits, wage garnishments and harassing phone calls. This is called the “automatic stay”, and it may be effective throughout the entire bankruptcy proceeding.

What type of bankruptcy is RIGHT for you?

The type of bankruptcy you choose to file depends on your personal and financial situation. We can help you with filing the following types of bankruptcy

Chapter 7. Allows you to cancel many or all of your debts. You don’t automatically lose your home or car! In order to file for Chapter 7 bankruptcy, your income must be below the state median for your household according to the “Means Test” (hyperlink “means test” to the “what is the bankruptcy means test table below OR see below)

Chapter 13. A “reorganization bankruptcy” in which you develop a repayment plan that allows you to pay back your debts over a three- to five-year period. You don’t pay back all the creditors, but work on a plan that lets you get back on track.  Chapter 13 can be used to save your home from foreclosure or you vehicle from repossession.

Filing for bankruptcy in Nebraska & Iowa

Exemptions are laws that allow you to keep property free from creditor claims, which means you get to keep these things when you file for bankruptcy. Our attorney will work with you to protect your property while getting relief from your debts.

What is the bankruptcy means test?

When declaring personal bankruptcy, you must determine if Chapter 7 or Chapter 13 is more appropriate for your situation. One way to do this is by taking the “means test”, which determines if your income is low enough to file for Chapter 7. If your income is higher than the state median for a household of your size, you must file for Chapter 13, and repay for a 5 year period.  The median income is calculated by the US Trustee’s office and is typically adjusted for cost of living increases bi-annually.
