The American Bankruptcy Institute is the nation’s leading provider of quality bankruptcy educational programs. They are dedicated to research and education and matters related to insolvency and publish various newsletters and journals on bankruptcy.

The National Association of Consumer Bankruptcy Attorneys is an organization dedicated to serving the needs of consumer bankruptcy attorneys and protecting the rights of consumer debtors in bankruptcy. They also file briefs to the highest courts on the subject of bankruptcy and provide education programs and workshops.

The Nebraska State Bar Association has a wealth of information about state laws and attorney services.

The Division for Public Education of the American Bar Association has an informative Q&A section regarding Chapter 7 “straight bankruptcy”.

The U.S. Bankruptcy Code is found in Title 11 of the United States Code. From this link to the U.S. House of Representatives, you can download the entire bankruptcy code or individual chapters such as Chapter 7 liquidation and straight bankruptcy, Chapter 13 debt adjustment and wage earners plans, and Chapter 11 business reorganization.

The website for the U.S. Bankruptcy Courts provides a great deal of information for consumers seeking basic information about bankruptcy on pages devoted to topics such as Bankruptcy Basics, Chapter 7, and Chapter 13.

For Chapter 13 bankruptcy and delinquent tax returns, this site will provide you with additional information and phone numbers.

The rules of court in bankruptcy cases are governed by the Federal Rules of Bankruptcy Procedure, which explain how to file a petition and see a case through the bankruptcy court. The language here can be very dense, so we recommend that you speak to an attorney before deciding to file a suit.

Credit and Debt Resources

The Fair Debt Collection Practices Act (FDCPA) is the federal law governing creditor harassment and the behavior of bill collectors. The FDCPA is enforced by the Federal Trade Commission (FTC), and you can find more consumer information on debt collection from the FTC here.

The National Foundation for Credit Counseling is a nationwide network of credit counselors helping consumers to drive down debt and regain control of their finances.

By law, you are entitled to one free copy of your credit report each year from the three main consumer credit reporting agencies (TransUnion, Experian, and Equifax). Mark your calendar to request a report from a different agency every four months. That way you can continually monitor your credit report at no cost. If you find any old or inaccurate information and have difficulty getting the credit reporting agency to remove it, give us a call. The Credit Card Accountability, Responsibility, and Disclosure Act of 2009 (CARD Act) changed the way credit card companies must disclose interest rates and other terms on your bill and in information they send to you. The Federal Reserve posted a summary of those requirements here.
